Please read these Terms of Service carefully before using Nooryak CRM. These terms constitute a legally binding agreement between you and Nooryak Technologies.

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Nooryak CRM platform, website, and related services (collectively, the "Service") provided by Nooryak Technologies ("Nooryak," "we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility & Account Registration

To use Nooryak CRM, you must:

  • Be at least 18 years old and capable of forming a binding contract
  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials and notify us of unauthorized access
  • Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false or misleading information.

3. Subscription Plans & Free Trial

Nooryak CRM may offer free trials, paid subscriptions, and plan tiers with varying features and user limits. Trial periods, pricing, and included features are described at the time of registration and may change with notice.

  • Free trials convert to paid plans unless cancelled before the trial ends
  • Fees are billed in advance according to your selected billing cycle
  • All fees are non-refundable except as required by law or stated in a separate agreement
  • We may modify pricing with at least 30 days' notice to existing subscribers

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws
  • Upload malicious code, spam, or content that infringes intellectual property or privacy rights
  • Attempt to gain unauthorized access to systems, accounts, or data
  • Reverse engineer, scrape, or resell the Service without written permission
  • Overload or interfere with the integrity or performance of the Service
  • Use the Service to send unsolicited communications in violation of anti-spam laws

5. Your Data & Content

You retain ownership of data and content you submit to the Service ("Customer Data"). You grant Nooryak a limited license to host, process, and display Customer Data solely to provide and improve the Service.

You are solely responsible for the accuracy, legality, and backup of Customer Data. We are not liable for loss of data resulting from your actions, third-party integrations, or circumstances beyond our reasonable control.

6. Intellectual Property

The Service, including software, design, logos, documentation, and trademarks, is owned by Nooryak Technologies and protected by intellectual property laws. These Terms do not grant you any right to use our branding except as necessary to use the Service in accordance with these Terms.

7. Third-Party Services

The Service may integrate with third-party applications and services. We are not responsible for third-party products, their availability, or their privacy practices. Your use of integrations is at your own risk and subject to those providers' terms.

8. Service Availability & Support

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance, updates, or events beyond our control may cause temporary downtime. Support levels depend on your subscription plan.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR MEET ALL YOUR REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOORYAK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Nooryak, its officers, directors, employees, and agents from claims, damages, and expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

12. Termination

You may cancel your account at any time through account settings or by contacting support. We may suspend or terminate access immediately for breach of these Terms, non-payment, or legal requirements. Upon termination, your right to use the Service ceases, and we may delete data after a reasonable retention period.

13. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in India, unless otherwise required by mandatory local law.

14. Changes to Terms

We may revise these Terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
